Attorney shuffle sparks dispute among officials

WOODSTOCK – Sheriff Keith Nygren is questioning why an assistant state’s attorney is being removed from a case where a political enemy is seeking a special prosecutor to investigate him.

A motion for a substitution of attorney has been filed to replace Assistant State’s Attorney Don Leist with private attorney Bill Caldwell. Both McHenry County State’s Attorney Lou Bianchi and McHenry County Board Chairman Ken Koehler signed the request.

A judge ruled Friday that prosecutors must stay on the case against McHenry County State's Attorney Louis Bianchi, rejecting their attempts to withdraw.

Special prosecutor Thomas McQueen had argued that because defense attorney Terry Ekl threatened to sue, alleging improper investigation and prosecution, he was ethically bound to withdraw — to avoid the appearance that he was influenced by a personal stake in the case.

A second special prosecutor wants out of the upcoming corruption trial of McHenry County State’s Attorney Louis Bianchi, who’s accused of doing legal favors for political supporters and relatives.

The request filed Tuesday by Thomas McQueen raises questions about who — if anyone — will prosecute Bianchi at his criminal trial scheduled to begin Aug. 1.

WOODSTOCK – The judge assigned to McHenry County State’s Attorney Lou Bianchi’s criminal case has declined to recuse himself despite special prosecutors’ request.

Special prosecutors had asked Winnebago County Judge Joseph McGraw to step down based on his relationship with the Illinois Office of the State’s Attorney Appellate Prosecutor.
